Terms of Service

1. Acceptance of Terms

By creating an account or using Commonwealth Finance Tracker Pro (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute the entire agreement between you and Commonwealth Finance Tracker regarding your use of the Service and supersede any prior agreements.

2. Description of Service

Commonwealth Finance Tracker Pro is a personal finance management application that allows users to record and track income, expenses, account balances, budgets, savings goals, recurring transactions, and net worth.

The Service is provided for personal, non-commercial use. It is a record-keeping and organisational tool only. It does not provide financial advice, investment recommendations, or any form of regulated financial service. Please read our Disclaimer for full details.

3. Account Registration & Security

To use the Service you must create an account with a valid email address and password. You agree to:

• Provide accurate and complete information when registering
• Keep your password confidential and not share it with others
• Complete the two-factor authentication process required at each login
• Notify us immediately at CommonwealthFinancialEducation@gmail.com if you suspect unauthorised access to your account
• Take responsibility for all activity that occurs under your account

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and use the Service.

4. Subscriptions & Billing

Free trial. New accounts are eligible for a 14-day free trial. No payment method is required to start the trial. If the trial expires without an active subscription, access to premium features will end.

Paid plans. Subscription plans are billed on a monthly, quarterly, or annual basis as selected at checkout. All payments are processed securely by Stripe. We do not store your payment card details.

Cancellation. You may cancel your subscription at any time from within the app (Settings → Subscription) or by contacting us. Upon cancellation, you will retain access until the end of your current billing period. No partial-period refunds are issued unless required by applicable law.

Price changes. We will give at least 30 days' notice of any price change by email before it takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Refunds. Refund requests are considered on a case-by-case basis. Contact us at CommonwealthFinancialEducation@gmail.com within 14 days of a charge if you believe a refund is warranted.

5. Your Data

You retain full ownership of all financial data you enter into the Service. We do not claim any rights to your data.

We collect and process your data in accordance with our Privacy Policy, which forms part of these Terms. Key points:

• Your data is stored securely in MongoDB Atlas with encryption at rest
• Your password is hashed with bcrypt and never stored in plaintext
• We will never sell, share, or trade your personal or financial data to third parties for commercial purposes
• You can export a full backup of your data at any time from Settings
• You can request deletion of your account and all associated data by contacting us

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Impersonate any person or entity
• Attempt to gain unauthorised access to the Service, its servers, or other users' accounts
• Introduce malicious code, viruses, or disruptive software
• Use automated systems to scrape, crawl, or extract data from the Service without our written permission
• Resell or sublicense access to the Service without authorisation

We reserve the right to suspend or terminate accounts that violate these provisions.

7. Intellectual Property

The Service, including its design, code, text, graphics, and all other content created by us, is owned by Commonwealth Finance Tracker and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for personal purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, or create derivative works of the Service or any part of it without our express written consent.

8. No Financial Advice

The Service is an organisational and record-keeping tool. Nothing in the Service constitutes financial advice, investment advice, tax advice, or any other regulated financial service. You should not make financial decisions solely on the basis of information displayed in the app.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant the accuracy or completeness of any information displayed in the Service, which is entirely dependent on data you enter.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Commonwealth Finance Tracker and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from your use of the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim or (b) $100 AUD.

Nothing in these Terms limits or excludes liability that cannot be excluded under applicable consumer protection law.

11. Termination

By you. You may stop using the Service at any time. To close your account and have all data permanently deleted, contact us at CommonwealthFinancialEducation@gmail.com. We will complete the deletion within 30 days.

By us. We reserve the right to suspend or terminate your account without notice if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law. In cases of termination for cause, no refund will be issued for any remaining subscription period.

Upon termination, your right to use the Service ceases immediately. Sections 7, 8, 9, 10, and 13 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email at least 14 days before the changes take effect. The updated Terms will be posted at this URL with a revised effective date.

Continued use of the Service after the effective date of updated Terms constitutes your acceptance of those Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Commonwealth Finance Tracker operates. Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, except where prohibited by applicable consumer protection law in your country of residence.
